Background of the Study

International legal frameworks are vital for regulating trade and protecting intellectual property rights in an increasingly globalized economy. The World Trade Organization (WTO) dispute settlement system serves as a cornerstone for resolving trade conflicts and ensuring that intellectual property rights are upheld across borders (Nwankwo, 2023). In Abuja, the application of these legal frameworks has been instrumental in shaping the national legal environment, influencing how domestic industries navigate international trade disputes and safeguard innovative outputs. The WTO’s mechanisms offer a structured process for addressing grievances, thereby promoting fairness and consistency in international trade practices (Eze, 2024). However, challenges remain regarding the accessibility and effectiveness of these dispute resolution processes, especially for developing economies. Concerns include lengthy adjudication periods, complex legal procedures, and potential biases favoring developed nations (Okoye, 2025). This study investigates how the WTO’s dispute settlement system impacts trade practices and intellectual property protection in Abuja. By analyzing case studies and legal outcomes, the research aims to elucidate the strengths and limitations of international legal frameworks and provide recommendations for enhancing their efficacy in protecting national interests.

Statement of the problem

Despite the existence of robust international legal frameworks, domestic industries in Abuja face challenges in leveraging the WTO’s dispute settlement system for protecting intellectual property rights. Critics argue that the complexities inherent in international legal procedures often limit the accessibility and effectiveness of these mechanisms (Akinyele, 2023). Moreover, discrepancies in legal interpretations and procedural delays have sometimes resulted in unfavorable outcomes for local stakeholders. This study seeks to address these gaps by assessing the extent to which the WTO dispute settlement system supports trade and intellectual property protection in Abuja, while identifying areas that require reform.

Objectives of the Study

 

To assess the impact of the WTO dispute settlement system on trade and intellectual property protection in Abuja.

 

 

To identify the challenges faced by local industries in utilizing international legal frameworks.

 

 

To propose recommendations for improving the effectiveness of dispute resolution mechanisms.

Significance of the Study

This study is significant as it provides critical insights into how international legal frameworks shape trade practices and intellectual property protection in Abuja. Its findings will inform policymakers and industry stakeholders on ways to enhance legal procedures and safeguard national interests in a globalized market (Nwankwo, 2023; Eze, 2024).

Scope and Limitations of the Study

This study focuses on the WTO dispute settlement system’s impact on trade and intellectual property in Abuja, limiting the analysis to legal mechanisms and dispute outcomes.
